The new gTLD domains, also called “brand domains” are very close to being active. Under this category, you can request domains that match already registered trademarks, but also domains that are generic names (a.e. “.abogados”) and demonyms (a.e. “.madrid”).<\/p>\n

In order to protect brand owners in the process of assigning these new domains and any future ones that may be requested, ICANN has created the so-called Trademark Clearing House (TMCH).<\/p>\n
The TMCH protection mechanism consists of incorporating those trademarks that are registered, regardless of the country of registration, in the TMCH Database in such a way as to avoid the possibility of a third party registering the \u201cbrand domain\u201d.<\/p>\n
Holders who register their trademarks in the TMCH will benefit from the alert service through which they will be automatically informed when a third party requests the new domain that matches their trademark in order to present the corresponding claim automatically. that the registration of the new domain may be blocked during the “sun rise” phase. It is expected that the alert that is sent will refer both to domain applications as such, and to second-level domains or domains composed of already granted domains, whose owners may request for themselves or for third parties (for example “abril.abogados”).<\/p>\n
The rules of trademark registration and checking and comparison with the potential domains that are assigned are pre-established, and their observance by all users and owners will be precise.
