<\/p>\nDomain names are a strategic asset for businesses in the digital environment. They are essential not only for conducting commercial activities but also for establishing and maintaining a distinctive brand identity. The UDRP therefore provides a fast and effective out-of-court mechanism enabling trademark owners to recover domain names that infringe their rights without resorting to court proceedings, thereby saving both time and costs.<\/p>\n
While many UDRP cases involve scams or fraudulent activities such as phishing, disputes also frequently arise from trademark conflicts between competitors. In such cases, a careful assessment of the factual and legal background is essential, taking into account the different jurisdictions and proceedings involved.<\/p>\n
We recently acted in a case in which a third party, despite having failed to register several trademarks following successful oppositions filed by our client before the EUIPO, continued to use a domain name that reproduced our client’s earlier trademark in its entirety in order to redirect users to its own business. At first sight, the EUIPO decisions appeared to place our client in a strong position. However, the matter was complicated by two key circumstances. First, the third party had successfully obtained a trademark registration in Australia, a jurisdiction where our client held no registered trademark rights. Secondly, the disputed domain name had originally been registered before our client’s trade mark registrations.<\/p>\n
In its decision in WIPO Case No. D2026-1216 (<beautyinandout.com>), the Panel held that the mere fact that the registrant of a disputed domain name owns a registered trademark does not automatically establish rights or legitimate interests in the domain name for the purposes of the UDRP. In proceedings where bad faith is a central element, the factual background of the dispute between the parties is decisive.<\/p>\n
The Panel considered several circumstances as evidence of bad faith and of the absence of rights or legitimate interests. These included the use of the disputed domain name to redirect users to the respondent’s website, where the earlier trademark was not used at all; the fact that the Australian trademark application had been filed only after the respondent had become involved in the EUIPO proceedings; and the lack of any genuine commercial use of the Australian registration, even within Australia.<\/p>\n
As regards the registration date of the domain name, the Panel found that, although the Whois records showed an original registration date of 2012, the respondent had in fact acquired the domain name several years later, after having unsuccessfully defended the opposition proceedings before the EUIPO. In this respect, evidence demonstrating the historical use of the domain name by previous registrants proved crucial.<\/p>\n
On that basis, the Panel concluded that the respondent had acted in bad faith both in acquiring and using the disputed domain name, upheld the complaint and ordered that the domain name be transferred to our client.<\/p>\n
This case once again highlights the importance of approaching domain name disputes from a comprehensive perspective, taking into account the client’s broader commercial history and looking beyond the existence of registered rights alone in order to ensure the effective protection of valuable intangible assets.<\/p>\n
