On January 1, 2026, the new edition of the Nice Classification will enter into force.
This update is particularly relevant and is one of the most significant in recent years, as it introduces a substantial change in the way goods and services will be classified from the new year onwards.
Until now, goods were classified based on their nature or composition. However, with this new edition, they will be classified according to their purpose or method of use.
The classification of services does not undergo any significant modifications and will continue to follow the current criteria.
Accordingly, with the entry into force of this new edition, the following goods will be reclassified:
- From Class 3 to Class 1 (essential oils)
- From Class 9 to Classes 10 or 12 (eyeglass/spectacle and lifesaving products)
- From Class 10 to Class 21 (tongue scrapers)
- From Class 11 to Class 25 (electrically heated clothing)
- From Class 21 to Class 17 (nozzles for watering hoses)
- From Class 28 to Class 12 (surf skis)
- From Class 29 to Class 30 (buttercream)
In addition to these reclassifications, the new edition removes certain terms that have been in use and incorporates many new ones.
This change will require greater precision when defining product lists in future trademark applications in order to avoid potential objections from the Trademark Office—precision that underscores the importance of professional advice.
