In order to deal with these assumptions, the first thing we analyze is the weighting of the two rights, depending on several factors that influence the analysis of the case, such as the intent to insult, the public interest or the public character status, the latest, for the special circumstances sometimes are diminished in their fundamental rights.

The right to honor is traditionally regarded as a right that affects only individuals, but this right also protects legal persons as acknowledged by our courts in recent judgments.
